The ABA Federal Civil Enforcement Committee continues its Nuts & Bolts Program Series with an overview on Sherman Act Section 2. The panel will explore the fundamentals of monopolization, from the various routes for showing monopoly power, to the elusive contours of exclusionary conduct (dubbed by Antitrust Law Developments as “one of the most vexing questions in antitrust law”), to attempted monopolization and conspiracy to monopolize. We’ll also dive into cutting edge applications of Section 2, including in the context of merger enforcement.
